The Justice Department told a federal appeals court on Wednesday that it should be able to release the January 6-related volume of its final report of special counsel Jack Smith days before Donald Trump takes office.

The U.S. Justice Department will not make public for now Special Counsel Jack Smith's report on Donald Trump's retention of classified records, it said on Wednesday, citing the ongoing prosecutions of two associates of the president-elect.

The judges left in place a lower-court injunction that bars the disclosure of the report for three days, and the Justice Department then appealed it.
